These Terms and Conditions ("Terms") govern your use of BluWave-ai EV Everywhere ("EV Everywhere App") provided by BluWave-ai ("Company," "we," "us," or "our"). By using the EV Everywhere App, you agree to comply with these Terms. If you do not agree with these Terms, please do not use the EV Everywhere App.

1. EV Everywhere App Usage: 

1.1 You must be at least 18 years of age to use the EV Everywhere App. 

1.2 You are responsible for maintaining the confidentiality of your account information and password associated with the EV Everywhere App. 

1.3 You agree not to use the EV Everywhere App for any illegal, unauthorized, or prohibited purposes.

2. Privacy: 

2.1 We collect and use personal data in accordance with our Privacy Policy. By using the EV Everywhere App, you consent to our data practices as described in the Privacy Policy.

3. Use of the EV Everywhere App: 

3.1 The EV Everywhere App is intended to assist users in optimizing their EV charging experience and contributing to grid stability. 

3.2 You understand that the accuracy and effectiveness of the EV Everywhere App's features depend on accurate and up-to-date information provided by you.

4. Subscription and Fees: 

4.1 Some future planned features of the EV Everywhere App may require a subscription fee. These will be communicated to the customer.

4.2 Subscription terms, pricing, and payment methods will be detailed within the EV Everywhere App. 

4.3 Subscriptions are automatically renewed unless canceled before the renewal date.

5. Intellectual Property: 

5.1 The EV Everywhere App and its content are owned by BluWave-ai and protected by intellectual property laws. 

5.2 You may not reproduce, modify, distribute, or create derivative works based on the EV Everywhere App without our prior written consent.

6. Limitation of Liability: 

6.1 The EV Everywhere App is provided "as is" and "as available." We do not guarantee that the EV Everywhere App will be error-free, secure, or uninterrupted. 

6.2 We shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use of the EV Everywhere App.

7. Indemnification:

7.1 You agree to indemnify, defend, and hold the BluWave-ai harmless from any claims, losses, or liabilities arising from your use of the EV Everywhere App.

8. Modifications: 

8.1 We reserve the right to modify, suspend, or discontinue the EV Everywhere App or any part thereof at any time without notice.

9. Governing Law: 

9.1 These Terms shall be governed by and construed in accordance with the laws of Ontario, without regard to its conflict of law principles.

10. Termination:

10.1 We reserve the right to terminate your access to the EV Everywhere App at our sole discretion, without prior notice.

11. Entire Agreement: 

11.1 These Terms constitute the entire agreement between you and BluWave-ai regarding the EV Everywhere App and supersede any prior agreements or understandings.
